§ 1 · Privacy Policy (GDPR)

BrandCanvasPoint is the data controller for personal data collected through this website. We process only what an order requires: your name, e-mail, telephone number, company name, project notes, and any details you voluntarily place on an order slip sent to [email protected].

Purpose & legal basis: responding to enquiries and preparing fixed-price quotes (Art. 6(1)(b) GDPR — pre-contractual steps); delivering contracted design work and issuing invoices (Art. 6(1)(b)); maintaining minimal accounting records (Art. 6(1)(c) — French commercial and tax law); improving the site through anonymous, aggregate usage statistics (Art. 6(1)(a) — consent via the cookie banner).

Retention: enquiry correspondence is kept for 12 months from the last exchange; client project files and invoices are retained for the statutory commercial period of 10 years; cookie consent records are kept for 6 months.

Recipients: data is handled by BrandCanvasPoint staff only. Processors with access — e-mail hosting, analytics, and payment providers — act under written agreements and may not use your data for their own purposes. We never sell or rent personal data.

Transfers: data is stored within the European Economic Area. Where a processor operates outside the EEA, transfers rely on Standard Contractual Clauses.

Your rights: you may request access, rectification, erasure, restriction, portability, or object to processing at any time by writing to [email protected]. You may also lodge a complaint with the CNIL (3 place de Fontenoy, 75007 Paris — cnil.fr).

§ 2 · Terms of Service

2.1 Scope. Every engagement begins with a written quote listing line items, deliverables, price, and schedule. Work starts once the quote is accepted and the 30% booking deposit is received. Anything outside the accepted quote is quoted separately.

2.2 Prices & payment. Prices are quoted in USD and are fixed for the scope described. Balances are due within 14 days of invoice unless otherwise stated. Payments are processed through our payment provider; card details never reach our servers. Late payments accrue the statutory penalty rate plus a €40 recovery fee.

2.3 Schedule & client duties. Turnaround times begin on the later of deposit receipt and receipt of all content, credentials, and feedback from you. Delays in providing materials extend the schedule day for day. Each line item includes two review rounds; further rounds are billed at the studio hourly rate.

2.4 Ownership. On final payment, all intellectual property in the client-specific deliverables — layouts, component code, and commissioned copy — transfers to you. BrandCanvasPoint retains the right to display the work in its portfolio unless you request confidentiality in writing. Third-party libraries remain under their own licences.

2.5 Warranties. Deliverables are warranted against material defects for 30 days after launch; we will correct verified defects free of charge. The warranty does not cover alterations made by third parties, unsupported browser versions, or failures caused by external hosting and plugins.

2.6 Liability. To the extent permitted by law, BrandCanvasPoint's liability for any claim arising out of an engagement is limited to the amount actually paid for the line item concerned. We are not liable for indirect or consequential loss, including lost revenue or data attributable to third-party services.

2.7 Governing law. These terms are governed by French law. Courts of Lyon have exclusive jurisdiction over any dispute that an amicable attempt fails to resolve.

§ 3 · Cookie Policy

3.1 What we store. A single essential record, bcp_cookie_consent, is written to your browser's local storage when you choose "Accept & Close" or "Essential only". It exists only to remember your choice so this notice does not reappear on every visit. It contains no identifier and is never transmitted to us.

3.2 Analytics. If you accept, we may collect anonymous, aggregated page-view counts (pages visited, device class, country) to understand which service lines are useful. These statistics contain no cookies of their own and cannot be used to identify you.

3.3 Third-party content. Embedded maps and font files are requested from Google Fonts and Google Maps; those providers may set their own technical cookies under their respective policies. Payment links open our payment provider's checkout in a new tab.

3.4 Managing cookies. You can clear the consent record at any time through your browser's site-data settings; the notice will then appear again and you can choose differently. Blocking all storage leaves the site fully readable — only the consent reminder repeats.

§ 4 · Refund & Cancellation Policy

4.1 Cooling-off period. Consumers resident in the EU may withdraw from a distance contract within 14 days of acceptance at no cost. If work has already begun at your explicit request, a prorated amount for work completed up to the withdrawal date is retained and itemised on the final invoice.

4.2 Deposits. The 30% booking deposit secures your slot in the studio calendar and is non-refundable once production has started. If you cancel before production starts, the deposit is refunded in full within 10 business days.

4.3 Work not as described. If a delivered line item materially differs from the accepted quote, notify [email protected] within 14 days of delivery. We will correct the discrepancy; if we cannot within a reasonable time, the affected line item is refunded in full or prorated, at your choice.

4.4 Retainers. The monthly care plan (BCP-145) can be cancelled at any time before the next 30-day cycle. Unused, prepaid cycles are refunded pro rata; work already performed in the current cycle is invoiced normally.

4.5 How to request a refund. E-mail [email protected] from the address used on your order slip with the invoice number and a short description. Approved refunds are issued to the original payment method within 10 business days of approval.
